It's sounds like the new Biden policy on transgender athletes in schools...

 is well meaning -- a compromise offered up in hopes that the recent statewide bans can be nullified if so that legally, things don't get pushed too far in favor of allowing the civil rights gains activists are pushing for...

Tell me how well that worked out with the "Don't Ask Don't Tell" military employment policies, say.

It's the same strategy, right?  Surrender on some of the issues and hope your enemies accept the peace offering?  They mean well, but legally, I think school kids can still stand up for their rights on an individual level in courtrooms across the nation, no matter the current presidential administration policies.

It's showboating, politically, isn't it?

Washington DC — Schools and colleges across the U.S. would be forbidden from enacting outright bans on transgender athletes under a proposal released Thursday from the Biden administration, but teams could create some limits in certain cases — for example, to ensure fairness.

The proposed rule sends a political counterpunch toward a wave of Republican-led states that have sought to ban trans athletes from competing in school sports that align with their gender identities. If finalized, the proposal would become enshrined as a provision of Title IX, the landmark gender equity legislation enacted in 1972.

It must undergo a lengthy approval process, however, and it's almost certain to face challenges from opponents.

Actually, maybe in this case, Don't Ask Don't Tell would be a better one for transgender athletes to purs ue if they can pass and  opt into a school district where their past is unknown.  We're not going to be gender-testing the athletes to "ensure fair competition" something tells me.  (Remember how badly those proposed mandatory drug tests for prep athletes went over, decades ago?)

I'd err on the side of giving trans kids the option of performing and competing athletically, and not worry too much about who is "winning" at the lower levels of play.  It's sport. The sooner they start the puberty blockers, the less advantage anyone has in crossover competition too.
